The $100,000 Question: Which H-1B Petitions for Nonimmigrant Workers Will Carry This Price Tag?

Since the Presidential Proclamation last month, employers have been grappling for guidance on when the $100,000 price tag for H-1B petitions will apply.  While we still await clarity on how the Presidential Proclamation will be implemented, we now have some context on when the $100,000 fee WILL NOT apply, including H-1B extensions, amendments, or transfers for individuals already inside the US. On October 20, 2025, U.S. Citizenship and Immigration Services (USCIS) released further guidance clarifying the implementation of the new $100,000 H-1B fee established under the recent Presidential Proclamation.
